This news is for extended family members who have made an application for EEA family Permit before 31 December 2020.
It appears that the Home Office may finally put an end to the limbo of the successful EEA appeals which cannot be implemented. As mentioned in the above letter (we have highlighted a relevant passage for your convenience), by Kevin Foster MP (Minister for Future Borders and Immigration), the Home Office may create a concession outside Appendix EU (Family Permit), which may be set out in the published EUSS family permit guidance, hopefully, soon.
This would eventually enable “an EUSS family permit to be granted to an extended family member who applied for an EEA family permit by 31 December 2020 and would have been granted this, including on appeal, had the route not closed“.
Perhaps, this issue may be finally clarified and solved by the Home Office, in the close future.
